Chapter 102


The Chapter 102 program in Susquehanna County, Pennsylvania, falls under the Pennsylvania Department of Environmental Protection (DEP) regulations. It focuses on managing erosion and sediment control, particularly during earth disturbance activities. Here’s an overview of the key aspects of this program:
Purpose and Scope, The Chapter 102 program aims to:
  • Protect Pennsylvania’s water resources from sediment pollution.
  • Ensure that earth disturbance activities do not degrade water quality.
  • Promote best management practices (BMPs) to control erosion and sedimentation.
Regulatory Requirements
  1. Erosion and Sediment Control Plans (E&S Plans):
    • Required for all earth disturbance activities of 5,000 square feet or more.
    • Plans must detail BMPs to minimize erosion and control sediment runoff.
    • Must be prepared and implemented by a qualified professional.
  2. National Pollutant Discharge Elimination System (NPDES) Permits:
    • Required for projects disturbing one acre or more.
    • Involves submitting an application to the DEP or delegated county conservation district.
    • Includes a review process to ensure compliance with state and federal water quality standards.
  3. Post-Construction Stormwater Management (PCSM) Plans:
    • Required for projects that will have permanent stormwater management BMPs.
    • Must address how stormwater will be managed after construction is complete.
Susquehanna County Implementation: The Susquehanna County Conservation District (SCCD) administers the Chapter 102 program locally. Our responsibilities include:
  • Reviewing E&S Plans and NPDES permit applications.
  • Conducting site inspections to ensure compliance.
  • Providing technical assistance and education to landowners and developers.
Best Management Practices (BMPs) Some common BMPs promoted under the Chapter 102 program include:
  • Compost Filter Sock (CFS) to catch sediment and filter water before it leaves the site.
  • Stabilized construction entrances to reduce mud tracking onto roads.
  • Sediment basins to capture and settle runoff during construction.
  • Vegetative stabilization (e.g., planting grass or trees) to prevent soil erosion.
Enforcement and Compliance
  • Inspections: Regular site inspections are conducted to ensure compliance with approved plans.
  • Violations: Non-compliance can result in enforcement actions, including fines and stop-work orders.
  • Remediation: Sites found in violation must take corrective actions to restore compliance and mitigate any environmental impacts.
